Use of Alcohol and Controlled Substances on University Property

I. DIRECTIVE
California State University, Fullerton is committed to creating and maintaining a safe and healthy learning and working environment for all members of the University community. For this reason, the University prohibits the possession, manufacture, sale, service, purchase, display, and/or consumption on University property of any alcoholic beverage or controlled substance, including marijuana, except as provided in this Directive.
II. AUTHORITY
California Code of Regulations, Title 5, Sections 42350 et. seq.; California Education Code Sections 89030 and 89031.
III. SCOPE
This Directive applies to any University academic, business or co-curricular program or activity occurring on any University property. University auxiliary organizations are responsible for applying similar practices to their respective programs and activities.
IV. DEFINITIONS
A. “Alcoholic beverage” is defined as beer, wine, champagne, distilled spirits or any other beverage containing alcohol.
B. “Controlled substance” is defined as any drug declared by federal or state law to be illegal for sale or use.
C. "University property” is defined as any University building or premises, including outdoor space, owned or controlled by the University.
V. IMPLEMENTATION
A. The University recognizes the need for an effective program to address alcohol abuse and the use of controlled substances (“Program”). The Vice President for Human Resources, Diversity and Inclusion is responsible for overall coordination of this Directive and the Program. This is also available in the main lobby areas of the Dean of Students Office, located in TSU-243; Contracts and Procurement, located in CP-300; and Human Resources, Diversity and Inclusion, located in CP-700.
B. Other than the exception described below, only the CSU Fullerton Auxiliary Services Corporation (“ASC”) may sell or serve alcoholic beverages on University property.
C. Vendors other than the ASC may sell or serve alcoholic beverages on University property only with the prior, written approval of the Vice President for Human Resources, Diversity and Inclusion.
D. The Program outlines the sale, service, consumption and/or marketing of alcoholic beverages in University residence halls, at intercollegiate athletic events, and at other University programs or activities on University property.
E. The Vice Presidents for Student Affairs and Human Resources, Diversity and Inclusion are responsible for compliance with regulations implementing the Drug Free Schools and Communities Act related to students and employees, respectively.
VI. ACCOUNTABILITY
The University will respond promptly to all reports of possible violations of this Directive or the Program. Any University faculty member, staff member, student or volunteer found to have violated this Directive or the Program will be subject to disciplinary action under University policies or as applicable, collective bargaining agreements.
